All customers are obligated to read, agree to and keep up-to date on each of these policies. By obtaining and continuing to use our service, you are agreeing to all of our service agreements.
Please be aware that these service agreements may change at anytime without advanced notice, though we will notify you of changes. If you have any questions, comments or concerns with any of our policies, please contact us.
The company shall be known throughout this document as Pink Shard.
IMPORTANT NOTICE: All payments to Pink Shard, are Non-Refundable unless stated
Pink Shard agrees to provide the client web hosting for a monthly/annual fee. Pink Shard will never require clients to advertise for Pink Shard on their website in any way shape or form unless agreed upon such as a non-profit organization receiving complimentary hosting. Clients are allowed to use the service for business/commercial or personal websites or content.
1. All services provided by Pink Shard may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United Kingdom (or any other country) law is prohibited. This includes, but is not limited to: copyrighted material, material that is threatening or obscene, material that is "illegal adult only" content, or material protected by trade secrets and other statue. The subscriber agrees to indemnify and hold harmless Pink Shard from any claims resulting from the use of the service which damages the subscriber or any other party.
Illegal Pornography and sex-related merchandising are prohibited on any server. This includes sexual content, or direct links to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet. Links to such materials are also prohibited. Pink Shard will be the sole arbiter as to what constitutes a violation of this provision.
2a. Examples of non-acceptable content or links:
- Pirated software
- Hacking programs or archives
- Warez Sites
- Illegal Porn
- Spamming Software
3. Background-running Programs:
We do not allow background-running programs. This includes any IRC related software such as bouncers and bots. In certain cases we may allow programs to run continually in the background, these are considered on a one to one basis and an extra charge may be incurred based on system resources used and operational maintenance needed.
4. Banned Scripts:
You are free to use any scripts you wish provided they do not affect the normal operations of the server and they are not mentioned specifically below. Scripts that are commonly known for causing server disruption include large cgi based message forums, auctions, and banner exchanges. In the event a script affects normal server and/or administrative operations, Pink Shard reserves the right to disable the account pending client cooperation and resolution.
4a. Scripts we do not allow include:
- Chat servers/scripts of any kind are strictly prohibited.
- Formmail.pl is not allowed on our servers.
You can use formmail scripts however; they must be up to date and not running with the filename "formmail.pl". Any files named "formmail.pl" will be deleted without notice.
5. Distribution and/or Transmission of Obscene or Indecent Speech or Materials:
Violation of indecency and obscenity laws can result in criminal penalties.
Material accessible to you through Pink Shard's Services may be subject to protection under United Kingdom (or any other country) copyright laws, or laws protecting trademarks, trade secrets or proprietary information. Except when expressly permitted by the owner of such rights, you must not use the Pink Shard Service in a manner that would infringe, violate, dilute or misappropriate any such rights, with respect to any material, which you access or receive through the Pink Shard Network. If you use a domain name in connection with the Pink Shard Service or similar service, you must not use that domain name in violation of any trademark, service mark, or similar rights of any third party.
Customers may not use the Pink Shard network with an attempt to circumvent user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for the customer, logging into a server or account the customer is not expressly authorized to access, password cracking, probing the security of other networks in search of weakness, or violation of any other organization's security policy. Customers may not attempt to interfere or deny service to any user, host, or network. This includes, but is not limited to, flooding, mail bombing, or other deliberate attempts to overload or crash a host or network. Pink Shard will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations. Users who violate system or network security may incur criminal or civil liability.
8. Resoure & Script Usage
Pink Shard accounts operate on shared resources. Excessive use or abuse of these shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in termination of your account.
You are prohibited from excessive consumption of resources, including CPU time, memory, disk space and session time. You may not use any more than 20% of server resources at any one time per account. You also may not use resource-intensive programs which negatively impact other customers or the performances of Pink Shard systems or networks. Pink Shard reserves the right to terminate or limit such activities.
Any accounts with scripts found in violation of these policies are subject to future scrutiny of all CGI, Perl, CFM, ASP, and PHP scripts by our System Administrators. If a script is found to be harmful to the system, it will be killed immediately and the account locked down until the account owners have been contacted. Malicious scripts are subject to immediate account termination without refund of any pre-paid monies.
Defamatory speech distributed over the Internet can result in civil liability for the defamer.
Pink Shard reserves the right at its sole discretion to refuse or cancel service. Violation of any of Pink Shard's terms of service or any other service policy could result in a warning, suspension, or possible account termination. Accounts terminated due to policy violations will not be refunded. Free domains which have been granted for customers paying annually are released to the customer at the end of there hosting period. Domains terminated due to service policy violations will incur an administrative charge of £10 before any domain is released to the customer.
You must not use the Pink Shard Network, Pink Shard equipment or any Pink Shard email address in connection with the transmission of spam, flames, mail bombs, or substantially similar, unsolicited email messages. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. This prohibition extends to the sending of unsolicited mass mailings from another service that in any way implicates the use of the Pink Shard Network, Pink Shard equipment or any Pink Shard email address. A message is considered unsolicited if it is posted in violation of a newsgroup charter or if it is sent to a recipient who has not requested or invited the message. For purposes of this provision, merely making one's email address accessible to the public will not constitute a request or invitation to receive messages.
If you are found to have spammed, Pink Shard reserves the right to disable your domain without warning. In addition, Pink Shard WILL impose am instant £150 penalty for each spam policy violation. Pink Shard solely reserves the right to refuse or cancel service to known spammers. Lastly, Pink Shard reserves the right to determine what violates this policy. As such, any violation may result in cancellation of services without refund.
Any attempts to undermine, slander, libel, threaten, or cause harm to a Pink Shard server, customer, employee, or the company directly is strictly prohibited and is grounds for immediate termination without refund. In addition, we will pursue all attempts to the fullest extent of the law.
To report abuse on our network or servers, please e-mail [email protected] providing as much information as you can.
Customer agrees that it shall defend, indemnify, save and hold Pink Shard (or it's employee's/owners) harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against Pink Shard, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Pink Shard against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Pink Shard server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party and (3) copyright infringement. Customer agrees to limit the liability of Pink Shard to the amount paid for service.
14. Dedicated Servers
There is an additional Terms of Service agreement which applies to dedicated server customers and can be found on our site at http://www.pinkshard.co.uk.co.uk/dedicated_terms_of_service.htm.
15. Free Domain Offer
When this offer is being run:
The terms & conditions for our free domain name offer are plain and simple. We will register the domain name for 1 year on your behalf. All we ask is that you stay hosting with us for a minimum of 6 months. If you decide to leave before 6 months and you want to take the domain with you we will only release it once you have paid our release fee of £10. If you stay for 6 months or longer and then decide to leave you are free to take the domain at no charge. After the initial year, you will then be invoiced subsequently for renewal of the domain name.
16. Account Setup
Orders are fulfilled within 24 hours of being received and upon valid payment. Payments are made to Pink Shard.
17. Refunds & Cancellation Policy:
Notice of cancellation must be received (7) seven days prior to next payment being due. If cancellation is received less than (7) seven days prior to next payment being due, client will be required to make their next payment before account can be cancelled.
18. Money Back Guarantee:
You may cancel your account at any time and receive a full refund (excluding any setup fees or domain name registrations fees incurred) if cancelled within our thirty (30) day money-back guarantee period.
After thirty (30) days you will be subject to our Refunds & Cancellation Policy. See clause 17
19. Billing & Late Payments
For payment, Pink Shard accepts MasterCard, Visa, Switch, Solo, Maestro, Cheque or Direct Bank Transfer. Pink Shard invoices exclusively via e-mail. Pink Shard do not send out invoices via postal services. Invoices are due immediately. Pink Shard do not offer a credit facility at this current time.
You are obligated to pay for your account even if you do not use it. Because we have provided you with usernames, passwords, DNS entries, and an IP address, you have the ability to use your account. The fact that you do not do so is not relevant - you are still obligated to pay for the account. Even an unused account uses valuable system resources that could be used for other customers.
At Pink Shard’s discretion customers are given a 7 day grace period from the due date. If on the 14th day of the due date payment has not been received or Pink Shard have not been contacted regarding payment, the account will be deemed late and will be subject to account suspension.
You will receive a payment reminder everyday from the start of your payment due date. Once 14 days have surpassed and payment has still not been received or we have not been contacted regarding payment, your account will be terminated without any further notice.
Reactivation of closed accounts due to delinquency incurs a £15 reactivation fee as well as payment of the balance due in full. For late payments please email [email protected] to arrange payment.
If your account is in arrears at the time the account is closed (either by your request or due to non-payment), the remaining balance must be paid within 30 days of when the account is closed. If we do not receive payment on the remaining balance in that time, we will begin efforts to collect any fees owed.
We apply a £20.00 collection fee to cover our costs in attempting to collect your debt. If our internal collection efforts fail, we reserve the right to turn the account over to a 3rd-party (either collections agency or solicitors) for further action. We also reserve the right to report your unpaid balance to credit reporting agencies as well as ISP/web host information services.
You must use only one of following methods to deliver an official written notice of cancellation:
To terminate your account we require you to email us with via the email account that is on file, specifying when you require your account to be cancelled. On receipt your account will be pending cancellation within 24 hours. Setup fees, when applicable, are non-refundable.
We will NOT accept telephone calls as a formal request for account termination.
21. SPAM / UCE
Pink Shard offers users a full range of both private and commercial hosting services. Abuse of these services is considered a violation of our Terms of Service/AUP ("Contract Agreement" You have executed before the service was started.) One of the most serious abuses is using your account to send unsolicited e-mail, otherwise known as "spam." The following are examples of spam and are blatantly contrary to our TOS/AUP.
21a. Inappropriate E-Mail Activities:
21b. Commercial e-mail: Defined as sending unsolicited commercial e-mails. This is prohibited. You are not permitted to use your Pink Shard account or e-mail alias/account of your Virtual Server to send unsolicited commercial e-mail. Using an e-mail address hosted anywhere on Pink Shard servers to collect responses from unsolicited commercial e-mail is prohibited. This includes using a throw-away, free e-mail account to promote your Pink Shard account and redirectors for the same account.
21c. Mail Bombing: Defined as sending large volumes of unsolicited e-mail to individuals from your Pink Shard account. This is strictly prohibited.
21d. Harassment: Defined as sending threatening or harassing e-mail after being requested to stop, is prohibited. Extremely threatening or harassing e-mail never is allowed.
22. Inappropriate Newsgroup Activities:
22a. Newsgroup Spamming: Defined as excessive cross-posting, or posting the same article to several newsgroups. This is prohibited. Generally accepted standards allow no more than 15 newsgroups, or cross-postings, for a single article or substantially similar articles. Such articles may be cancelled. You are not allowed to use your Pink Shard based mail facilities to SPAM the newsgroups.
22b. Off topic or inappropriate postings: There is no restriction on content, except as defined by each newsgroup. Continued posting of off-topic articles is prohibited. Please note that commercial advertisements are off-topic in the vast majority of newsgroups.
23. Should you violate Pink Shard's SPAM policy, you WILL be fined £150, plus £150 per hour for the time it takes us to "clean-up" your SPAM. This shall include but not be limited to the time required to answer e-mails from angry recipients of your SPAM and/or repair of a damaged server due to the "Mail Bombing" or other actions of the angry recipients in retaliation of your SPAM. You will also be charged £20 per gigabyte of data transfer that your SPAM incurred, including bandwidth used by answers to complaints about your SPAM. We will invoice this amount and should it not be paid, we will take full legal action against you in court, and/or we will contact a collection agency to recover the funds. Please note also that it is now considered a crime to send UCE (unsolicited commercial e-mail) as it falls into the category of "junk faxes." Pink Shard will turn over all names and personal information to the proper local, state, federal, and international officials of any person who violates this policy.
We take a very dim view of SPAM. It is one of the most annoying things encountered on the Internet. Any Pink Shard client found to be spamming will have his/her account terminated immediately - no questions asked (we will investigate the report thoroughly before terminating any account). There is no warning or second chance. If we find that you have violated our Terms of Service, we will report you and the incident to the proper local, state and federal authorities and will prosecute you to the full extent of the law.
We are not attempting to censor, nor are we attempting to curtail the business of our customers. But as a whole, spamming hurts our members and us more than it helps the one spammer. Do yourself, and us, a favour: PLEASE DON'T DO IT.
If you know of any Pink Shard client that is or might be violating this policy, please send a message or, if possible, forward the SPAM or UCE in full (including headers) to [email protected].
24. Bandwidth Usage Policy
Pink Shard's bandwidth policy is simple! You are allotted a portion of bandwidth per month to do with as you please. You can use this bandwidth for anything you want besides things not permitted as outline in this Terms of Service Agreement. If/When you reach 80% of your allotted amount of bandwidth in a given month, you will receive an email notifying you of this. We strongly recommend you contact us to either upgrade your account or purchase additional bandwidth. If your notice is ignored or no action is taken on your part your account will be suspended automatically and you will be expected to pay for the additional bandwidth used.
Pink Shard provides a bandwidth estimate figure in your control panel. This is an estimate and is provided from the server level. Actual account bandwidth usage is measured for billing purposes at the port level. This policy exists because many users offer files for download via FTP which is not otherwise measured by the server directly at this time. Please note that because the bandwidth is monitored at the port, any and all traffic for your Web Site is tracked including, but not limited to: FTP uploads and downloads, mail sending and retrieval, normal Web traffic, etc. Everything that is pushed from our server to a third-party's machine is considered bandwidth and will be measured.
We have designed this policy because many users find that hosts offer "unlimited" bandwidth only to find out that it has a very real bandwidth limit. Further, they place restrictions on what you can use the bandwidth for (i.e. no image galleries because they are a large source of bandwidth consumption). We tell you up-front how much bandwidth you are allocated each month and you have the full amount to use.

25 Pink Shard will not be responsible for any damages your business may suffer. Pink Shard makes no warranties of any kind, expressed or implied for services we provide. Pink Shard disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Pink Shard and its employees. Pink Shard makes no "uptime" guarantees.
Pink Shard keeps backups of key server systems only. Pink Shard can accept no responsibility for any loss of data or consequences arising from this. Pink Shard always advises clients to back up their site data regularly for its own protection.
Pink Shard furthermore expects that its customers who provide hosting services (resellers) to others will ensure its customers fully comply with all applicable laws concerning the privacy of online communications and any other policy of Pink Shard. A customer's failure to comply with those laws will violate this policy.
If a customer provides hosting services (resellers) to others and decides to cancel their reseller hosting account with Pink Shard then Pink Shard will not be responsible for maintaining hosting for the resellers customers. However, both customer and Pink Shard may come to a mutual agreement of Pink Shard taking over customers clients.
Finally, Pink Shard wishes to emphasize that in accepting services, customers indemnify Pink Shard for the violation of any law or Pink Shard policy that results in loss to Pink Shard or the bringing of any claim against Pink Shard. This means that if Pink Shard is sued because of activities of the customer that violate any law, or this policy, the customer will pay any damages awarded against Pink Shard, plus costs and reasonable legal fees.
Failure to comply with any of our terms & conditions will result in grounds for immediate account termination.
Pink Shard reserves the right to change, edit, or update the policies contained in this document at any time for any reason without notice.
The company shall be known throughout this document as Pink Shard.
We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998) and according to the Which? Web Trader Code of Conduct.
We collect information about you for 2 reasons: firstly, to process your order and secondly, to provide you with the best possible service.
We will not pass your e-mail address to other trusted traders unless you agree.
The type of information we will collect about you includes:

The personal information which we hold will be held securely in accordance with our internal security policy and the law and the Which? Web Trader Code. If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first.
We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings. Websites are prohibited from containing; Warez' content or content commonly known to be pirated or illegal copies of software or other works, MP3’s or other audio formats of copyrighted music, Movie downloads in any format whether complete or in part, Pornographic material, any content that is illegal under UK or European law.
Standard email services supplied with shared and email only hosting packages
Our shared and reseller hosting, also our email only hosting plans, are provided with email services and facilities. The maximum permissible emails that can be sent out in any single hour is 300 from a domain. We do not provide catch all mailboxes as these are commonly spam magnets.
Mass mailing is not allowed on Pink Shard shared hosting servers. Anyone who sends mass mail and is found to have caused problems affecting Pink Shard mail servers or IP reputation will be subject to a fine and have their domain and service suspended.
Any user who by their action or inaction and who's services are found to be sending spam emails will be levied a fine of £90.00 to cover Pink Shard's time in performing any cleanup action required to our mail servers. Any user who by their action or inaction and who's service causes IP black listings will be given a fine of £200.00. Any user who by their action or inaction and who's services result in complaints from other companies, for example spamcop, aol, yahoo etc will be given a fine of £90.00 to cover administration fee’s for Pink Shard to advise the companies the reasons why the spam was sent.
Database usage and abuse
Any customer who's database service usage results in excessively high server resource utilisation to the detriment of service or to our other customers will have their database suspended pending remedial action. Should such action not be taken and a further suspension be made an administration fee of £35.00 will be levied for our time. The onus is on the customer to monitor database space usage and take action to ensure they do not exceed their database limits. Any service found to exceed storage limits may result in automatic suspension of services. Where this occurs we will unsuspend services on request and remedial action should be taken by the customer. Where overuse occurs we reserve the right to charge for space used over and above allowances in order to prevent future suspensions or to charge for future unsuspensions at the rate of £35.00 per instance.
We will always do our best to be respectful and in our dealings with you, by email or by phone, treat you in the manner in which we ourselves would expect to be treated. We fully expect that our customers will treat us the same way. That can be a challenge sometimes for both parties as we recognise that things can sometimes get frustrating. Computers do have errors (often caused by humans) and humans also make mistakes from time to time. Whether those computers or humans are either yours or ours, we expect that both parties will remain calm and deal with any issues that occur professionally. On rare occasions a customer will become threatening or abusive. This can manifest itself in the use of all capitals in email (considered in general internet terms as shouting) or the use of abusive language. On the phone this includes shouting and abusive language. On such occasions we reserve the right not to answer the email or to hang up. We don't need any abuse and simply won't tolerate it.
Suspension and Termination
We will determine, in our sole discretion, whether you have breached this acceptable use policy. When a breach of this policy has occurred, we may take such action as we deem appropriate.
Failure to comply with this acceptable use policy constitutes a material breach of our Standard Terms and Conditions and, in addition to our rights contained therein, may result in our taking all or any of the following additional actions:
We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.
Sometimes things just don't work out
Although we try our best, and although we know both ourselves and our customers have the best intentions at heart, things might get to a point where they are not working out for either party.
It may be that you just cannot understand our systems or processes or perhaps you can't understand how to use things. It may be that we, try as we might, cannot satisfy your requirements.
Just as you can leave or choose not to renew your services with us without giving a reason we may decide that in everyone's best interest and to avoid further anguish we will not renew your service with us.
Of course we really hope and will try our best to ensure that things don't get to that stage, however if they do, we'll be sure to give you at least a months notice to give you a chance to make alternative arrangements.
If you have a complaint then there are ways in which you can address them. We'll do everything we can to deal with any complaint raised and if we can find a way to resolve any issue to your satisfaction we will. Your first port of all is email [email protected] with full details of your complaint.
Changes to our acceptable use policy
We may revise this acceptable use policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in this acceptable use policy may also be superseded by provisions or notices published elsewhere on our site.
We aim to give good service and value for money, however we recognise that from time to time issues can arise that need to be escalated. The following section gives information on how to contact us, and what to do if you have a complaint.

You should expect to receive a response to your query within seven working days of us receiving your correspondence.
Step two: what we will do
On receipt of your complaint our Customer Support Team will thoroughly investigate any issues raised and propose a course of action for resolution.
Step three: if you are not satisfied

Step four: what we will do
On receipt of your complaint our Technical Director will thoroughly investigate any issues raised and propose a course of action for resolution.

Once you have a response from our Customer Service Director, if you remain unsatisfied with our attempts to resolve the issue, you can contact Trading Standards.
We are happy to answer any questions you may have regarding your Pink Shard services.
Please note that any discussions with Pink Shard are treated in strictest confidence, so we may need to ask you security questions to confirm that we are speaking to the right person.
Please note: by signing up for any of our services you agree to be bound by all Pink Shard's terms and conditions.
You invest in us, we invest for you. If our server and/or network uptime is anything short of 100% uptime, we will gladly credit your account. If we fail to meet our ZERO Downtime promise during any calendar month, you can expect to receive a service credit as follows:

If for some reason we fail to respond to a support ticket regardless of the time of day or night within 24 hours we will issue a 1% credit for every occurance.
In the event that your server's critical hardware fails, to the extent that it is not able to function as a web-server, we will endeavour to fix the fault within 12 hours of the fault developing/being reported.
In the event that time taken to resolve the hardware failure exceeds 12 hours, for any individual incident, a service credit of 10% of your monthly fee will be credited to your account.
The period hardware is deemed to be be out of service commences when the fault is identified and ends when the server's critical services are operational again or when an alternative temporary server has been provided. This SLA only covers hardware faults, it does not cover time for software or operating system reconfiguration.
The Pink Shard free trial is limited to two months and commences on your sign-up date. You may cancel the trial at any time before it concludes, at which point your data will be deleted within 48 hours.
